How to Correct Information on a Claim After Filing

To correct information on your claim, such as the amount or defendant's name, or to add another defendant, you can "amend" your claim.

If the claim has not been served on the defendant:

  • Add "AMENDED" at the top of the claim forms provided to you after filing your claim.
  • Correct the forms by updating the amount or changing the defendants.
  • Return the claim forms to the court where your case was filed.
  • To change the trial date for more time for service, submit the completed form Request to Postpone Trial (SC-150) or write a letter. Submit the request at least 3 days before the trial date.
  • You will receive your documents back to serve on the defendant(s).

If the claim has been served on the defendant:

  • Fill out the form Request To Amend Party Name Before Hearing (SC-114) .
  • Serve a copy of the Request on the defendant(s) by hand delivering or mailing a copy and completing number 3a. on the form. Notify other served parties, even if not changing their name, via phone, e-mail, or fax. Complete 3b. on the form.
  • File the original form with the court before the trial date.

If you served one defendant but need to add another unserved one, you may need to amend your form and file a SC-114. Processes may vary by county, so contact your local court clerk to confirm.
