Damages - Incorrectly Calculated (Service)
The amount of damages that the Plaintiff can recover should be reduced because the Plaintiff failed to calculate their damages correctly.
The Plaintiff may have failed to properly calculate the following amounts as part of their damages:
- Compensatory damages (depending on what the Plaintiff claims)
- Consequential damages (if certain conditions are met)
- Litigation-related expenses (such as filing fees)
They may have also failed to subtract damages that should have been deducted from the total damages claimed. For example, they should have subtracted any damages that were reduced or eliminated by defenses you can claim (such as mitigation, unconscionability, etc.).
Lastly, the Plaintiff may have also failed to consider the language of the agreement itself, which may have provided requirements for how the damages should be calculated.
