Damages - Right to Withhold
You had the right to withhold the product from, or to stop its delivery to the Plaintiff because one of the following is true:
(1) The Plaintiff did not pay for the product as agreed (e.g., either in full and/or on time), or
(2) You sold the product to the Plaintiff on credit, but before the Plaintiff received it, you discovered that the Plaintiff could not pay for it.
As a result, you did one of the following:
You withheld delivery of the product to the Plaintiff and kept it in your possession, or
After the product left your possession and while it was in the process of being delivered to the Plaintiff, you recovered the product before it was delivered.
