Damages - Expressed or Implied Warranty

Because the Plaintiff violated one of the following types of product warranties, you did not pay for the product:

(1) Express Warranties are the Plaintiff’s verbal or written statements of fact, promise, or description about the product that become the reason for why you bought a particular product (the “basis of the bargain”). The Plaintiff may have given you express warranties about the product. The Plaintiff violated their express warranties to you if the product that they provided did not conform with the “basis of the bargain.” To prove the Plaintiff’s violation, it is only required to show that the buyer could have relied on their statements, but the buyer does not have to show their actual reliance.

(2) Implied Warranties exist based on your assumption that the product will do what it is intended to do and will apply even if not referenced in the agreement. The Plaintiff violated their implied warranties to you if the product that they provided did not do what it was supposed to do, and if they did not disclaim these warranties.

*Note that although the Plaintiff violated one of these warranties, you could still owe damages to the Plaintiff based on other grounds.

Daños - Garantía Expresa o Implícita

El Demandante le otorgó garantías expresas e implícitas sobre la condición del producto. Debido a que el Demandante violó uno de los siguientes tipos de garantías de producto, usted no pagó por el producto:

(1) Las Garantías Expresas son declaraciones de hecho, promesas o descripciones verbales o escritas del Demandante sobre el producto que se convierten en la "base del acuerdo". El Demandante violó sus garantías expresas hacia usted si el producto que proporcionaron no se ajustaba a la "base del acuerdo". Para demostrar la violación del Demandante, solo se requiere que demuestre que podría haber confiado en sus declaraciones, pero no es necesario demostrar que realmente confió en ellas.

(2) Las Garantías Implícitas existen en base a su suposición de que el producto hará lo que se supone que debe hacer.

Tenga en cuenta que aunque el Demandante violó una de estas garantías, aún podría deber daños al Demandante basados en otros motivos.
