You reasonably believed that the entire agreement was invalid because:

• the subject matter, or the dwelling being rented/leased, is illegal
• the purpose, or why the dwelling was being rented/leased, is illegal or seriously immoral, or
• the consideration, or the benefit that you or the Plaintiff received from the agreement, is illegal

Because of these circumstances, you did not believe that a tenancy agreement was created and you did not believe that the money the Plaintiff provided was a security deposit. Therefore, the court may refuse to award the Plaintiff statutory damages for bad faith retention of a security deposit because you can demonstrate that you kept the money in good faith.

Debido a estas circunstancias, usted no creía que se hubiera creado un acuerdo de arrendamiento y no creía que el dinero que el Demandante proporcionó fuera un depósito de seguridad. Por lo tanto, el tribunal no debería otorgar al Demandante daños estatutarios por la retención de mala fe de un depósito de seguridad porque usted puede demostrar que mantuvo el dinero de buena fe.
