Damages - Undue Influence
You reasonably believed you were under undue influence when you entered into the agreement: the Plaintiff had more power in your relationship and unfairly persuaded you and placed improper pressure to induce you into entering into the agreement against your will. Often, this defense arises when the two parties have a special relationship, such as a caregiver relationship.
Because of these circumstances, you did not believe that a tenancy agreement was created and you did not believe that the money the Plaintiff provided was a security deposit. Therefore, the court may refuse to award the Plaintiff statutory damages for bad faith retention of a security deposit because you can demonstrate that you kept the money in good faith.
Example
You were recovering from a physical injury at home, and the Plaintiff was providing home nursing care for you. They asked you to rent them an apartment that you had available. You did not want to rent them the apartment, but you believed that if you said no, the Plaintiff would stop providing care for you. You agreed to rent the apartment to avoid losing the nursing care.
