Your agreement states that the Plaintiff must pay in advance and so your obligation to perform is conditioned on their performance as follows:

(1) If the Plaintiff did not pay in full, you are not obligated to perform at all, or

(2) If the Plaintiff paid partially, even though you are not obligated to perform at all until the full payment is made, you decided to partially perform based on how much they paid.

Alternatively, if your agreement does not state when the Plaintiff had to pay for your service or product, this defense can also apply if you offered or tried to perform, but the Plaintiff either did not pay, did not try to pay, or did not offer to pay.

Incumplimiento - Cumplimiento
