Agreement - Illegal
The entire agreement is invalid because:
- The subject matter, or the result of the agreement, is illegal
- The purpose, or why the agreement was made, is illegal or seriously immoral, or
- The consideration, or the benefit that you or the Plaintiff received from the agreement, is illegal
Because the entire agreement is invalid, the court may undo it depending on what you knew about the illegality when you entered into the agreement.
Example
Your neighbor asked if they could lend you $1,000 in cash, and if you could then repay the money in one week. During the time when you were borrowing the money, you saw police searching your neighbor’s home and overheard them talking about looking for money connected with a robbery. Based on what you observed, you then made an intelligent assumption that your neighbor asked you to temporarily keep the money because it was stolen, and they did not want the police to find it.

Acuerdo - Ilegal
El acuerdo completo es inválido porque:
- El objeto del acuerdo, o el resultado del acuerdo, es ilegal.
- El propósito, o la razón por la que se hizo el acuerdo, es ilegal o gravemente inmoral, o
- La contraprestación, o el beneficio que usted o el Demandante recibieron del acuerdo, es ilegal.
Dado que el acuerdo completo es inválido, puede pedir a la corte que lo deshaga dependiendo de lo que sabía sobre la ilegalidad cuando celebró el acuerdo.
Ejemplo
Su vecino le preguntó si podía prestarle $1,000 en efectivo, y si luego podría devolver el dinero en una semana. Durante el tiempo en que estaba tomando prestado el dinero, vio a la policía buscando en la casa de su vecino y los escuchó hablar de buscar dinero relacionado con un robo. Basándose en lo que observó, llegó a la conclusión de que su vecino le pidió que guardara temporalmente el dinero porque era robado y no querían que la policía lo encontrara.
