Settlement Offer Letter to Resolve Your Lawsuit
A settlement offer letter is a letter you (as the defendant) can send the plaintiff before the trial hearing date so you can ask the plaintiff to dismiss the case and avoid going to court. Sending a settlement letter may be a good idea if:
- You have evidence to prove that you do not owe the plaintiff any money.
- You do owe the plaintiff money, but you have evidence to show that you owe the plaintiff less than what they claim.
- You want to offer to pay the plaintiff to avoid having to go to court.
- You acknowledge that you owe the plaintiff money but would need to repay in smaller payments over time.
Once the plaintiff accepts the terms of the letter and dismisses the case, you will then be in a "contract" with the plaintiff based on what you are offering to the plaintiff. If you do not follow the terms you both agreed to, the plaintiff may bring another case against you based on breaching the contract.

The introduction of a settlement offer letter will be a brief explanation of whether you agree or disagree with the Plaintiff's claim and a summary of what you expect from the plaintiff. The information section will explain the evidence you have to support your side of the story. You will want to make sure the plaintiff is aware that you will use the same evidence to support your side if this case does go to court. Lastly, you will want to be clear about what you are requesting from the user, specifically if you want them to dismiss the case against you.
The same settlement offer letter can be used during trial or mediation to show the court that you have demonstrated a desire to resolve this case with the Plaintiff.
