The Plaintiff violated their requirements to provide and/or maintain a safe living environment for you. Some of their requirements may be identified in your agreement, but even if they aren’t in your agreement, they may still apply to your agreement under the law. The Plaintiff was required to do certain things to ensure that the rental property was safe and livable throughout the entire time that you lived there. Some of these requirements include ensuring working utilities (plumbing, water, heat, electric) and proper locks.

Because the Plaintiff failed to provide safe living conditions in your rental property, you properly did not pay the rent as agreed because you either: (1) made repairs and deducted the cost of the repairs from your rent, or (2) you withheld rent.

Incumplimiento - Estado de la Propiedad

El Demandante violó sus obligaciones de proporcionar y/o mantener un entorno de vida seguro para usted. Algunas de estas obligaciones pueden estar especificadas en su acuerdo, pero incluso si no lo están en su acuerdo, siguen siendo aplicables según la ley. El Demandante estaba obligado a realizar ciertas acciones para garantizar que la propiedad de alquiler fuera segura y habitable durante todo el tiempo que usted vivió allí. Algunas de estas obligaciones incluyen asegurarse de que los servicios públicos funcionen adecuadamente (fontanería, agua, calefacción, electricidad) y que haya cerraduras adecuadas.

Debido a que el Demandante no proporcionó condiciones de vida seguras en su propiedad de alquiler, usted no pagó adecuadamente el alquiler según lo acordado porque o bien: (1) realizó reparaciones y dedujo el costo de las mismas del alquiler, o (2) retuvo el alquiler.
