Damages - Additional Damages
You do not have to pay the Plaintiff any additional damages claimed (such as late performance penalties) because they are not part of the original agreement and/or they are prohibited under the law.
If additional damages are not part of the original agreement, a party can ask the Plaintiff to provide support for why they are claiming that the party owes them. The Plaintiff can only collect these damages if they comply with the law.
Example
You borrowed $1,000 from the Plaintiff, and your agreement did not require you to pay an additional fee if you paid the loan late. You repaid the loan but paid it late, and the Plaintiff is suing you for $1,250. They claim that you owe $1,000 for the loan and $250 as a late fee. You do not owe this fee because the agreement did not provide for it.

Daños - Daños Adicionales
Usted no tiene que pagar al Demandante ningún daño adicional reclamado (como tarifas por pago atrasado) porque no forman parte del acuerdo original y/o están prohibidos por la ley.
Si los daños adicionales no forman parte de su acuerdo original, puede pedir al Demandante que proporcione pruebas de por qué están reclamando que les debe. El Demandante solo puede cobrar estos daños si cumplen con la ley.
Ejemplo
Usted tomó prestados $1,000 del Demandante, y su acuerdo no requería que pagara una tarifa adicional si pagaba el préstamo tarde. Usted devolvió el préstamo pero lo hizo tarde, y el Demandante lo está demandando por $1,250. Alegan que debe $1,000 por el préstamo y $250 como tarifa por pago atrasado. No debe esta tarifa porque el acuerdo no la contemplaba.
