Breach - Force Majeure Clause
You did not have to timely perform, or perform at all because an extraordinary event occurred after the agreement was made that prevented your performance as agreed. Your agreement (or the law) provides that performance by either party would be excused or delayed due to uncontrollable events that you did not cause.
Example
You borrowed money from the Plaintiff in January 2020 for the purpose of renovating your restaurant, and the loan agreement stated that if an extraordinary event prevented your ability to repay, your repayment obligation would be excused. You paid your contractor in February 2020 to perform the renovations, and you were supposed to repay the loan in March 2020. However, due to a major earthquake, the contractor stopped working and your restaurant closed. The force majeure clause allowed you to delay your obligation to repay the loan.

Incumplimiento - Cláusula de Fuerza Mayor
No estaba obligado a cumplir de manera oportuna porque ocurrió un evento extraordinario después de que se hizo el acuerdo que impidió su cumplimiento oportuno. Ejemplo
Usted tomó prestado dinero del Demandante en enero de 2020 con el propósito de renovar su restaurante, y el contrato de préstamo establecía que si un evento extraordinario impedía su capacidad de pago, su obligación de pago quedaría excusada. Usted pagó a su contratista en febrero de 2020 para realizar las renovaciones, y se suponía que debía pagar el préstamo en marzo de 2020. Sin embargo, debido a un terremoto importante, el contratista dejó de trabajar y su restaurante cerró. La cláusula de fuerza mayor le permitió retrasar su obligación de pagar el préstamo.
