Agreement - Gift
At the time you accepted what the Plaintiff gave or did for you:
(1) You reasonably understood that they meant it to be a gift that you did not have to repay, OR
(2) You knew you had to repay but something happened later which turned it into a gift.
Example
You did not have enough money to pay your rent so the Plaintiff gave you $1,000 to help you. You accepted the money and used it for rent as intended.
- When the Plaintiff gave you the money, they told you that it was a gift and that you did not need to pay them back, OR
- When the Plaintiff gave you the money, they told you that the money was a loan that you would have to repay. However, one month later, the Plaintiff sent you a text message letting you know that you would not need to repay the $1,000 to them and to consider the money a gift.

Acuerdo - Regalo
En el momento en que aceptó lo que el Demandante le dio o hizo por usted:
(1) Usted entendía razonablemente que se trataba de una regalo que no tenía que devolver, O
(2) Algo sucedió después que lo convirtió en una regalo.
Ejemplo
Usted no tenía suficiente dinero para pagar su alquiler, así que el Demandante le dio $1,000 para ayudarle. Usted aceptó el dinero y lo utilizó para el alquiler según lo previsto.
- Cuando el Demandante le dio el dinero, le dijo que era una regalo y que no tenía que devolvérselo, O
- Cuando el Demandante le dio el dinero, le dijo que era un préstamo que tendría que devolver. Sin embargo, un mes después, el Demandante le envió un mensaje de texto informándole que no tendría que devolver los $1,000 y que considerara el dinero como un regalo.
